2026 CFL PICK"EM X OLD DUTCH CONTEST

 

Standard data rates apply to entrants who choose to participate in the Contest via a mobile device.  Please contact your service provider for pricing and service plan information and rates before mobile device participation.

 

  1. KEY DATES:

 

The 2026 CFL Pick'Em x Old Dutch contest (the “Contest”) begins on May 7, 2026, at 1:00 p.m. Eastern Time (“ET”) and ends on October 24, 2026 at 2:59 p.m. ET (the “Contest Period”).

 

  1. ELIGIBILITY TO ENTER:

 

Contest is open to residents of Canada who have reached the legal age of majority in their province/territory of residence; except employees, representatives or agents (and their immediate family members and persons living in the same household, whether related or not) of Old Dutch Foods, Ltd. (the “Sponsor”), CFL Ventures (the “CFL”) and each of their affiliates and related entities (including the Canadian Football League, CFL Enterprises LP, CFL Enterprises G.P. Inc, CFL Holdings G.P. Inc., and CFL Holdings L.P. and member teams of the Canadian Football League), each of their respective parent companies, general partners or partners, subsidiaries, affiliates, prize suppliers, advertising/promotion agencies and any other individual(s), entity or entities involved in the development, promotion, production, implementation, administration, judging or fulfillment of the Contest (collectively, the “Contest Parties”).   

 

  1. AGREEMENT TO BE LEGALLY BOUND BY RULES: 

 

By participating in this Contest, you are signifying your agreement that you have read and agree to be legally bound by these Official Rules and Regulations (the “Rules”).

 

  1. HOW TO ENTER:

 

NO PURCHASE NECESSARY.  MAKING A PURCHASE WILL NOT INCREASE OR OTHERWISE IMPACT YOUR CHANCES OF WINNING IN THIS CONTEST.  

 

To enter the Contest, you must have a valid CFL Gamezone account.  A CFL Gamezone account is free, but is subject to acceptance of the Terms of Use, which can be found at: https://www.cfl.ca/terms-of-use/.

 

Further, you must go to gamezone.cfl.ca/Pickem/ and follow the on-screen instructions to sign in and agree to these Rules to enter the Contest. You can earn one (1) entry (each, an “Entry” and collectively, the “Entries”) per Prize in the Contest as follows. The details of each Prize is provided in Section 9.

 

Early Bird Prizing: 

  • Chip Coupons – If you are one of the first 200 entrants to make your Week 1 CFL picks, you will receive a Chip Coupon via mail. 

 

Regular Prizing:

  • Daily Prizes – Once you’ve submitted your first CFL picks for the week, you will be automatically entered into the Daily Prize draw. Daily Prize draws will start on June 1, 2026 (before the start of Week 1 of the 2026 CFL season).  If you select your first CFL pick after Week 1 of the CFL 2026 season, then your chances of winning a Daily Prize will reduce accordingly depending on when you select your first pick.
  • Weekly Prizes – You must submit your CFL picks prior to the beginning of each game for the given week. 
  • Old Dutch Crunch Time Moment Prizes – You must select your “Old Dutch Crunch Time Moment” picks for the given week. 
  • Grand Prize – You must select all game predictions taking place over the 21-week 2026 CFL regular season.
  • 2nd - 50th Place Prize - You must select all game predictions taking place over the 21-week 2026 CFL regular season.
  • 51st – 250th Place Prize – You must select all game predictions taking place over the 21-week 2026 CFL regular season.

 

Solely at your option, you may opt-in to receive information and promotional offers from the Sponsor and/or CFL. Your consent for communications can be withdrawn at any time after you have been contacted.  Opting in to such communications is not required to enter the Contest and does not impact an entrant’s odds of winning.

 

To be eligible, all content and materials associated with your Entry (collectively, the “Entry Materials”) must: (i) be submitted and received in accordance with these Rules during the Contest Period; (ii) include all required components and materials noted above; and (iii) be in accordance with these Rules, including, but not limited to, the specific Submission Requirements listed below in Rule 7.

 

  1. ENTRY CONDITIONS:

 

There is a limit of one (1) Entry per prize per Pick’Em account during the Contest Period.  If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) obtain more than one (1) Entry per prize; and/or (ii) use multiple names, multiple identities, multiple accounts, any automated, macro, script, robotic or other system(s) or program(s), and/or any other means not in keeping with the Sponsor’s interpretation of the letter and spirit of these Rules to enter or otherwise participate in or to disrupt this Contest; then he/she may be disqualified from the Contest in the sole and absolute discretion of the Sponsor.  The Contest Parties and each of their respective agents, shareholders, officers, directors, employees, successors, and assigns (collectively, the “Released Parties”) are not responsible for, and accept no liability whatsoever in relation to, any late, lost, misdirected, delayed, incomplete or incompatible Entries and/or Entry Materials (all of which are void).  

 

An Entry may be rejected if, in the sole and absolute discretion of the Sponsor: (i) the Entry (including, but not limited to, any associated Entry Materials) is not submitted and received in accordance with these Rules during the Contest Period; and/or (ii) the Entry Materials accompanying the Entry are not in compliance with these Rules (including, but not limited to, the specific Submission Requirements listed below in Rule 7)and/or the applicable Social Platform (as defined below) rules (all as determined by Sponsor in its sole and absolute discretion).

 

  1. VERIFICATION:

 

All Entries, Entry Materials and entrants are subject to verification at any time and for any reason.  The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Entry, Entry Materials and/or other information entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with the Sponsor’s interpretation of the letter and spirit of these Rules.  Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor.  The sole determinant of the time for the purposes of this Contest will be the official time-keeping device(s) of the Sponsor.

 

  1. SUBMISSION REQUIREMENTS:

 

BY SUBMITTING AN ENTRY, YOU AGREE THAT THE ENTRY (AND EACH INDIVIDUAL COMPONENT THEREOF – INCLUDING, WITHOUT LIMITATION, THE ENTRY MATERIALS) COMPLIES WITH ALL CONDITIONS STATED IN THESE RULES. THE RELEASED PARTIES WILL BEAR NO LIABILITY WHATSOEVER REGARDING: (I) THE USE OF YOUR ENTRY (OR ANY COMPONENT THEREOF – INCLUDING, WITHOUT LIMITATION, THE ENTRY MATERIALS); (II) PARTICIPATION IN ANY CONTEST-RELATED ACTIVITIES; (III) ANY USE, COLLECTION, STORAGE AND DISCLOSURE OF ANY PERSONAL INFORMATION IN CONNECTION TO THE ADMINISTRATION OF THE CONTEST; AND/OR (IV) IF DECLARED A WINNER, THE PRIZE (INCLUDING ANY USE OR MISUSE OF A PRIZE).  THE RELEASED PARTIES SHALL BE HELD HARMLESS BY YOU IN THE EVENT IT IS DISCOVERED THAT YOU HAVE DEPARTED FROM OR NOT OTHERWISE FULLY COMPLIED WITH ANY OF THESE RULES AND THIS RELEASE AND INDEMNITY SHALL CONTINUE IN FORCE FOLLOWING THE TERMINATION OF THE CONTEST AND/OR AWARDING OF ANY PRIZES.  

 

By participating in the Contest, each entrant hereby warrants and represents that any Entry Materials he/she submits: 

 

  1. is/are original to him/her and/or that the entrant has obtained all necessary rights in and to the Entry Materials for the purposes of entering such Entry Materials in the Contest;

 

  1. does not violate any law, statute, ordinance or regulation;

 

  1. does not contain any reference to or likeness of any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the age of majority in their jurisdiction of residence; 

 

  1. will not give rise to any claims whatsoever, including, without limitation, claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party; and

 

  1. is/are not defamatory, trade libelous, pornographic or obscene, and further that it will not contain, depict, include, discuss or involve, without limitation, any of the following: nudity; alcohol/drug consumption or smoking; explicit or graphic sexual activity, or sexual innuendo; crude, vulgar or offensive language and/or symbols; derogatory characterizations of any ethnic, racial, sexual, religious or other groups (including, without limitation, any competitors of Sponsor); content that endorses, condones and/or discusses any illegal, inappropriate or risky behaviour or conduct; personal information of individuals unless consent to provide such information has been received, including, without limitation, names, telephone numbers and addresses (physical or electronic); commercial messages, comparisons or solicitations for products or services other than products of Sponsor; conduct or other activities in violation of these Rules; and/or any other materials that are or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor in its sole and absolute discretion.

 

The Sponsor and/or its contest administrator or designated content moderator (the “Reviewer”) reserves the right to screen all Entry Materials. Any Entry Materials that the Reviewer deems, in its sole and absolute discretion, to violate the terms and conditions set forth in these Rules are subject to disqualification.  The Reviewer reserves the right, in its sole and absolute discretion at any time and for any reason, to remove any Entry Materials (or any part thereof) where possible and/or to request an entrant to modify, edit and/or re-submit his or her Entry Materials (or any part thereof) in order to ensure that the Entry Materials comply with these Rules, or for any other reason.   If such an action is necessary at any point during or after the Contest, then the Sponsor reserves the right, in its sole discretion, to take whatever action it deems necessary based on the circumstances – including, without limitation, disqualifying the Entry Materials (and therefore the corresponding Entry and/or the associated entrant) – to help ensure that the Contest is being conducted in accordance with the Sponsor’s interpretation of the letter and spirit of these Rules.

 

  1. LICENSE:

 

By entering the Contest and submitting an Entry, each entrant: (i) grants to the Sponsor, in perpetuity, a non-exclusive license to publish, display, reproduce, modify, edit or otherwise use his/her Entry Materials (and each component thereof), in whole or in part, for administration, advertising or promotion of the Contest or for any other reason; (ii) waives all moral rights in and to his/her Entry Materials (and each component thereof) in favour of the Sponsor (and anyone authorized by the Sponsor to use such Entry Materials); and (iii) agrees to release and hold harmless the Sponsor and all of the other Released Parties from and against any and all claims, damages, liabilities, costs, and expenses arising from use of his/her Entry Materials (or any component thereof), including, without limitation, any claim based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related or other cause of action whatsoever.   

 

  1. THE PRIZES:

 

The following prizes (collectively, the “Prizes” and each a “Prize”) are available to be won.  Where applicable, the number of Prizes will decrease as awarded throughout the Contest Period:

  • 200 free chip coupons (“Chip Coupon”) (ARV: CAD$6);
  • 146 daily prizes (1 prize awarded for each day during June 1, 2026 – October 24, 2026) (the “Daily Prizes”), each prize consisting of a CFL hat (ARV: CAD$40);
  • 21 weekly prizes (1 prize awarded per week during June 1, 2026 – October 24, 2026) (the “Weekly Prizes”), each prize consisting of two (2) 2027 season tickets to winners CFL team of choice (ARV: CAD $1,000); 
  • 210 Weekly Old Dutch Crunch Time Moment prizes (10 prizes awarded per week during June 1, 2026 – October 24, 2026) (the “Weekly Old Dutch Crunch Time Moment Prizes”), each prize consisting of two (2) coupons for a free Old Dutch product (“Free Product Coupon”) (ARV: CAD$6); 
  • 1 grand prize (the “Grand Prize”), consisting of a round trip for 2 to Calgary, Alberta, one (1) standard double occupancy hotel room for two (2) people for three (3) nights, two (2) tickets to the 2026 Gray Cup Game (the “Grey Cup Game”), $500 cash or cash equivalent and Old Dutch chips for a year (10 bags/month) (ARV: CAD$6,720);
  • 49 2nd – 50th Place Prizes ("2nd – 50th Place Prizes”), each consisting of two (2) tickets to a 2027 CFL regular season game of winner’s choice and an Old Dutch Chip Prize Pack (ARV: CAD$130); and
  • 200 51st to 250th Place Prizes (“51st – 250th Place Prizes”), each consisting of an Old Dutch Chip Prize Pack (ARV: CAD$30).

 

Under no circumstances whatsoever will any difference between the actual and approximate retail values be awarded.

 

Each winner is solely responsible for payment of any applicable taxes and reporting any taxable income associated with a Prize. 

 

Grand Prize: The Grey Cup Game is currently scheduled to take place on November 15, 2026 – however, the Grey Cup Game date is subject to change. All travel must take place between November 13, 2026 – November 16, 2026 (or on such other date(s) as specified by the Sponsor in its sole and absolute discretion). Choice of flights, airline(s) and all other aspects of the Grand Prize are at the sole and absolute discretion of the Sponsor.  

 

IMPORTANT NOTE: In the event that a confirmed Grand Prize winner resides within a three hundred (300) kilometer radius of Calgary, Alberta (as determined by the Sponsor in its sole and absolute discretion), Sponsor will determine, in its sole and absolute discretion, whether or not the Grand Prize will include airline travel, another form of transportation to and from Calgary, Alberta, or reimbursement for certain incurred fuel costs. All decisions of the Sponsor in this regard will be final and binding without right of appeal.

 

Guest Requirements for Grand Prize: The confirmed Grand Prize winner’s guest must return the Sponsor’s release (by the date indicated on the release form) indicating that he/she waives all recourse against the Released Parties relating to his/her participation in the Grand Prize (including, without limitation, any travel related thereto).

 

The Grand Prize winner and his/her guest must be able to travel together on the dates and at the times designated by the Sponsor or the Grand Prize will be forfeited and may be awarded to an alternate eligible entrant at the Sponsor’s sole discretion.  

 

The Grand Prize winner and his/her guest must participate in all aspects of the Grand Prize together (i.e. the Grand Prize winner cannot have a different guest for different aspects of the Grand Prize). All travel arrangements, accommodations, scheduled events and other aspects of the Grand Prize itinerary will be arranged by the Sponsor in its sole and absolute discretion.  Once the travel itinerary has been finalized between the Grand Prize winner and Sponsor, no changes can be made unless initiated or approved by Sponsor.

 

It is strongly recommended and encouraged that the confirmed Grand Prize winner and his/her guest obtain sufficient personal travel and medical insurance prior to departure. Flights are subject to availability, blackout periods, government restrictions and regulations, airline, airport or other transportation restrictions and regulations.  Stadium entry is subject to stadium rules and policies.

 

The Grand Prize winner and his/her guest are responsible for all required travel documentation including a valid passport and/or travel visas (where applicable) and must be free from any legal restrictions on their ability to travel or otherwise participate in the Grand Prize that has been awarded.   

 

Flights in connection with the Grand Prize do not qualify for loyalty points of any kind. 

 

Without limiting the generality of the foregoing, the following general conditions apply to each Prize: (i) the Prize must be accepted as awarded and is not transferable, assignable and/or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion); (ii) no substitutions are permitted, except at Sponsor’s option; (iii) all travel related to the Grand Prize must occur within and/or on or before the date or dates specified by the Sponsor (otherwise the Grand Prize may, in the sole and absolute discretion of the Sponsor, be forfeited in its entirety and, if forfeited, nothing will be substituted in its place); (iv) the confirmed Grand Prize winner and his/her guest must have all necessary documentation to permit travel, including to onboard flights (as applicable) and entry into the stadium, and must travel on the same itinerary; (v) with respect to the Grand Prize, the costs of everything not specifically and expressly stated above as included in the Grand Prize are the sole and absolute responsibility of the confirmed Grand Prize winner and his/her guest, including, without limitation: meals and drinks; gratuities; entertainment; health and travel insurance; transportation for confirmed Grand Prize winner and his/her guest to and from the Canadian airport selected by the Sponsor; additional transportation; baggage and other fees; and items of a personal nature (NOTE: confirmed Grand Prize winner and/or his/her guest may be required to present a valid major credit card in his/her name at the time of hotel check-in to cover any incidental expenses); (vi) if a confirmed winner (or in the case of the Grand Prize the confirmed Grand Prize winner and his/her guest) do not utilize any part(s) of the Prize, then any such part(s) not utilized may, in the sole and absolute discretion of the Sponsor, be forfeited in their entirety and, if forfeited, nothing will be substituted in their place; (vii) Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Prize or any component thereof; and (b) substitute the Prize or a component thereof for any reason with a prize or prize component(s) of equal or greater retail value, including, without limitation, but solely at the Sponsor’s sole discretion, a cash award; (viii) with respect to the Grand Prize, all travel arrangements relating to the Grand Prize must be made through the Sponsor or its designated agents; and (ix) by accepting the Prize, a confirmed winner agrees to waive all recourse against the Released Parties if the Prize or a component thereof does not prove satisfactory, either in whole or in part.  

 

The Released Parties are not responsible for any delay, postponement, suspension, rescheduling or cancellation, for any reason, of any aspect of a Prize – including, but not limited to flights or games. Neither a confirmed winner nor his/her guest (as applicable) nor any other person or entity will be compensated in the event of such delay, cancellation or other event contemplated herein.  The Sponsor will not replace any lost or stolen tickets. Changes to flights and/or passenger names are not accepted once bookings have been confirmed.

 

None of the Released Parties makes any representation or offers any warranty, express or implied, as to the quality or fitness of the Prize awarded in connection with the Contest. To the fullest extent permitted by applicable law, each confirmed winner and his/her guest (as applicable) understands and acknowledges that he or she may not seek reimbursement or pursue any legal or equitable remedy form either the Sponsor or any of the other Released Parties should his/her Prize fail to be fir for its purpose or is in any way unsatisfactory.

 

By entering this Contest and accepting a Prize, each confirmed winner agree to maintain his/her behavior in accordance with all applicable laws and generally accepted social practices in connection with participation in any Contest or prize-related activity, including at the games. Each confirmed winner understands and agrees that Sponsor or prize providers have the right, in their sole discretion, to disqualify and remove a confirmed winner(s) and their guest from any activity at any time if a confirmed winner(s)' or guest's behavior at any point is uncooperative, disruptive, or may or does cause damage to person, property, or the reputation of any Contest Parties or other view violates the policies of the prize providers, and in such a case, the Prize winner(sP) will still be solely responsible for all expenses related to the prize.

 

In connection with attendance at the 2027 CFL games and/or the 2026 Grey Cup Game, as applicable, each confirmed winner agrees that stadium policies, airline policies (as applicable), CFL policies, provincial/federal guidelines and the recommendations of health officials must be followed. In addition, each confirmed winner and guests should be aware of and comply with government guidelines regarding travel restrictions and mandatory quarantines before and after travel (if applicable). Please note that any public location where people are present provides an inherent risk of exposure to COVID-19, and the Contest Parties cannot guarantee that any person will not be exposed during a visit.

 

The applicable Prize winner(s) and his/her guests acknowledge and accept all risk of damages, injury or other loss incidental to any game for which tickets are issued, whether occurring before, during or after the game, and hereby voluntarily agrees to assume the same.  

 

  1. ELIGIBLE WINNER SELECTION PROCESS:

 

Chip Coupon:

  • The first 200 eligible entrants who make their Week 1 CFL Picks will receive a Chip Coupon.

 

Daily Prizes:

  • Every Tuesday during the Contest Period starting on June 9, 2026 (the “Daily Prize Selection Date”) in Toronto, Ontario at approximately 10:00 a.m. ET, seven (7) eligible entrants will be selected by random draw from among all eligible Entries submitted and received from the previous week, in accordance with these Rules (provided that such entrant has not previously been selected for a Daily Prize).  

 

Weekly Prizes:

  • Every Tuesday during the Contest Period starting on June 9, 2026 (the “Weekly Prize Selection Date”) in Toronto, Ontario at approximately 10:00 a.m. ET, one (1) eligible entrant with the top weekly score in CFL Pick’Em for the previous week will be selected, in accordance with these Rules (provided that such entrant has not previously been selected for a Weekly Prize). If there are multiple eligible entrants tied with the top score for the week, one (1) eligible entrant will be selected by random draw from among all eligible Entrants tied for the top score.

 

Weekly Old Dutch Crunch Time Moment: 

  • Every Tuesday during the Contest Period starting on June 9, 2026 (the “Crunch Time Moment Prize Selection Date”) in Toronto, Ontario at approximately 10:00 a.m. ET ten (10) eligible entrants will be selected based on random draw of all eligible entrants who have selected their "Crunch Time Moment" for the previous week, in accordance with these Rules (provided that such entrants have not previously been selected for a Crunch Time Moment Prize). 

Grand Prize:

  • On Tuesday October 27, 2026 (the “Grand Prize Selection Date”) in Toronto, Ontario at approximately 10:00 a.m. ET, one (1) eligible entrant with the top score in CFL Pick'Em at the end of the CFL regular season (without missing a week of play) will be selected, in accordance with these Rules. If there are multiple eligible entrants with the top score, then one (1) eligible entrant will be selected by random draw from among all eligible Entries submitted and received in accordance with these Rules.

2nd - 50th Place Prizes:

  • On Tuesday October 27, 2026 (the “2nd – 50th Place Prize Selection Date”) in Toronto, Ontario at approximately 10:00 a.m. ET, forty-nine (49) eligible entrants who are in 2nd – 50th place for CFL Pick'Em at the end of the CFL regular season (without missing a week of play) will be selected, in accordance with these Rules. If there are multiple eligible entrants in the same place, then one (1) eligible entrant will be selected by random draw from among all eligible Entries submitted and received in accordance with these Rules and the remaining eligible entrants will fill out the remaining spots, as applicable.

51st - 250th Place Prizes: 

  • On Wednesday November 11, 2026 (the “51st – 250th Prize Selection Date”) in Toronto, Ontario at approximately 10:00 a.m. ET, two hundred (200) eligible entrants who are in 51st – 250th place for CFL Pick'Em at the end of the CFL regular season (without missing a week of play) will be selected, in accordance with these Rules. If there are multiple eligible entrants in the same place, then one (1) eligible entrant will be selected by random draw from among all eligible Entries submitted and received in accordance with these Rules and the remaining eligible entrants will fill out the remaining spots, as applicable.

The Daily Prize Selection Date, Weekly Prize Selection Date, Crunch Time Moment Prize Selection Date, Grand Prize Selection Date, 2nd – 50thPrize Selection Date, and 51st – 250th Prize Selection Date, each a “Selection Date”.

 

The odds of winning depend on the number of eligible Entries submitted and received and/or participants' scores on CFL Pick'Em, as applicable, in accordance with these Rules.   

 

  1. ELIGIBLE WINNER NOTIFICATION PROCESS:

 

With respect to all Prizes except the Grand Prize, the Sponsor or its designated representative will contact the eligible winner(s) by email from the email address noreply@promotionsolutions.net (i) within seven (7) business days of the Selection Date, or (ii) in the case of the Chip Coupon, within seven (7) business days of receiving the first 200 eligible Contest Entries. If the eligible winner(s) do(es) not respond within 48 hours of Sponsor’s attempt to contact, or if there is a return of any notification as undeliverable; then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to select the next runner up for the Prize among the remaining eligible Entries submitted and received in accordance with these Rules in accordance with the procedures outlined in Rule 10 (in which case the foregoing provisions of this section shall apply to such newly selected eligible prize winners).  

 

With respect to the Grand Prize available to be won under the Contest, the Sponsor or its designated representative will contact the eligible winner(s) by email from the email address noreply@promotionsolutions.net within three (3) business days of the Selection Date.  If the eligible winner(s) do(es) not respond within 48 hours of Sponsor’s attempt to contact, or if there is a return of any notification as undeliverable; then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Grand Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible entrant and/or select the next runner up (as applicable) for the Grand Prize from among the remaining eligible Entries submitted and received in accordance with these Rules in accordance with the procedures outlined in Rule 10 (in which case the foregoing provisions of this section shall apply to such newly selected eligible Grand Prize winner).  

 

  1. ELIGIBLE WINNER CONFIRMATION PROCESS:

 

NO ONE IS A WINNER UNLESS AND UNTIL THE SPONSOR OFFICIALLY CONFIRMS HIM/HER AS A WINNER IN ACCORDANCE WITH THESE RULES.  BEFORE BEING DECLARED AS A CONFIRMED PRIZE WINNER, each eligible winner will be required to, as applicable: (a) provide all information required by the Sponsor or the CFL (as Contest administrator) to verify the potential winner’s identity and to fulfill the Prize; (b) correctly answer a mathematical skill-testing question without mechanical or other aid (which may, in the sole and absolute discretion of the Sponsor, be administered online, by email or other electronic means, by telephone, or in the Sponsor’s form of declaration and release); (c) confirm that they and their guest, as applicable, is able to use the Prize, and (d) sign and return within 48 hours of being notified as a selected winner the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of and ability to use the Prize (as awarded); (iii) releases the Sponsor and all of the other Released Parties from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of his/her Prize or any portion thereof; (iv) agrees to indemnify the Released Parties against any and all claims, damages, liabilities, costs, and expenses arising from use of his/her Entry Materials or any portion(s) thereof; and (v) agrees to the publication, reproduction and/or other use of his/her name, city/province/territory of residence, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner or medium whatsoever, including print, broadcast or the internet.  

 

If an eligible winner, as applicable,: (a) fails to provide proof of identity and/or information as requested by the Sponsor or the CFL (as Contest administrator); (b) fails to correctly answer the skill-testing question; (c) fails to return the properly executed Contest documents within the specified time; (d) cannot accept (or is unwilling to accept) or cannot use the Prize (as awarded) for any reason; and/or (e) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then he/she will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible entrant and/or select the next runner up (as applicable) for the applicable Prize from among the remaining eligible Entries submitted and received in accordance with these Rules in accordance with the procedures outlined in Rules 10 and 11 (in which case the foregoing provisions of this section shall apply to such newly selected eligible winner).  

 

  1. GENERAL CONDITIONS:

 

Sponsor may delegate any or all of its responsibilities as Contest sponsor hereunder to CFL as Contest administrator.

 

This Contest is subject to all applicable federal, provincial and municipal laws.  The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal.  ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THE SPONSOR’S INTERPRETATION OF THE LETTER AND/OR SPIRIT OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME. 

 

The Released Parties will not be liable for: (i) any failure of any website or any platform during the Contest; (ii) any technical malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Entry, Entry Materials and/or other information to be received, captured or recorded for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the internet or at any website; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; (v) anyone being incorrectly and/or mistakenly identified as a winner or eligible winner; (vi) any stolen, lost, late, misdirected, damaged Prizes, and/or (vii) any combination of the above. 

 

Social Media Platforms Not Involved: The Contest is in no way sponsored, endorsed or administered by, or associated with any social media platform, including but not limited to Facebook, Instagram, TikTok, LinkedIn or X (formerly Twitter) (each, a “Social Platform”). Each Social Platform, as applicable, is hereby completely released of all liability by each entrant in this Contest. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not to a Social Platform. 

 

The Sponsor reserves the right to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules, including, without limitation, any error, problem, computer virus, bugs, tampering, unauthorized intervention, fraud or failure of any kind whatsoever.  

 

The Sponsor reserves the right to cancel, amend or suspend this Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever.   

 

Any attempt to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.  

 

The Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.

 

By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted for the purpose of administering the Contest and in accordance with Sponsor’s and CFL's (as Contest administrator) privacy policies (available at: https://www.olddutchfoods.ca/privacy-policy and https://www.cfl.ca/privacy-policy, as applicable).  This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.

 

The Sponsor reserves the right to adjust any of the dates, timeframes and/or other Contest mechanics stipulated in these Rules, to the extent deemed necessary by Sponsor, for purposes of verifying compliance by any entrant, Entry, Entry Materials and/or other information with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.

In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and disclosures or other statements contained in any Contest- related materials, including, but not limited to, the French versions of these Rules, point of sale, television, print or online advertising, and/or any instructions or interpretations of these Rules given by any representative of the Sponsor, the terms and conditions of these English Rules shall prevail, govern and control to the fullest extent permitted by law.

 

The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision.  In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.  

 

To the fullest extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules or the rights and obligations of entrants, Sponsor or any of  the Released Parties in connection with the Contest will be governed by and construed in accordance with the domestic laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.  The parties hereby consent to the exclusive jurisdiction and venue of the courts located in Ontario in any action to enforce (or otherwise relating to) these Rules or relating to this Contest.
